Identification of the contracting parties
Seller: This online store (E-commerce) www.yolovivo.com is owned by YOLOVIVO S.L. with CIF: B16706319, with registered office at Alameda Mazarredo, 25, 1º 48009 Bilbao, Spain. Registration: BOOK 0, VOLUME 6021, REGISTRATION Nº1 of the Mercantile Registry of Bizkaia.

Buyer: person who acquires through this portal ticket(s) to participate in any of the experiences offered by the seller.
Beneficiary: person who has a valid ticket to participate in any of the Yolovivo Experiences, other than the person purchasing the ticket.
SPECIFIC CONDITIONS OF SALE
a. Technical procurement process
The purchase of tickets will be made using the Wix event system, or the one enabled at any given time for each experience.
The purchaser must follow the established online purchase procedure.
During the purchase process the buyer may purchase one or more tickets for the same Experience.
The purchase of ticket(s) for different Experiences must be made in separate purchase processes for each desired Experience.
Likewise, the buyer must fill in and/or check the information requested at each step. During the purchase process and before making the payment, it will be possible to modify the purchase data.
Once payment has been confirmed, the purchaser will receive an email with confirmation of their booking and details of how to connect to the event via Zoom or the designated platform.
The purchase of tickets will be made using the Wix store system, or the one enabled at any given time for each experience.
The purchaser must follow the established online purchase procedure.
Likewise, the purchaser must fill in and/or check the information requested at each step. During the purchase process and before making the payment, it will be possible to modify the purchase data.
Once the payment is confirmed, the buyer will receive an email with the confirmation of his/her reservation. Yolovivo will then contact the buyer to arrange the best day and time to enjoy the experience. Once the date has been agreed upon, the buyer will receive an email with the details to connect to the event via Zoom or the designated platform.
b. Prices and payments
The price of the Experience will be the price displayed in the description of the event at all times.
The currency will be in Euros (€) and include taxes, unless, by legal requirement, especially in relation to VAT, a different matter is indicated and applied.
Under no circumstances will the Website automatically add additional costs to the price of an experience.
Prices may change at any time, but any changes will not affect purchases for which a booking confirmation has already been received.
The price paid for the Experience entitles the user to connect only ONE device through the link provided by Yolovivo, S.L.
The accepted means of payment are:
- Credit card via Wix Payment
- Payment via Paypal.
Credit cards will be subject to checks and authorisations by the issuing bank. If the issuing bank does not authorise the payment, Yolovivo, S.L. will not be responsible for not formalising the contract with the buyer.
Once Wix Payment receives the purchase order from the buyer, a pre-authorisation will be made on the corresponding card to ensure that there are sufficient funds to complete the transaction.
Once the credit card has been charged, the purchaser will be sent confirmation of the booking and details of access to the event.
In all cases, by clicking on "(buy, accept, pay)" the buyer confirms that the payment method used is their own or that they are the legitimate holder of the card used.
The purchaser will receive confirmation of the reservation made by e-mail with the access data to connect to the event.
Once the purchase procedure has been completed, the purchaser consents to the Web Site generating an electronic invoice which may be sent to him/her by e-mail.
d. Technical means to correct errors
The purchaser is informed that in the event that he/she detects that an error has occurred when entering data necessary to process his/her purchase request on the Website, he/she may modify them by contacting Yolovivo, S.L. through the contact spaces provided on the Website and, where appropriate, through those provided for contacting customer service, and/or using the contact details provided in the first clause (General Information).
In any case, prior to making the payment for the desired Experience, the purchaser, before clicking on "(buy, accept, pay)", may browse and correct the data that he/she considers appropriate.
e. Acceptance of the characteristics of the Experience
By making the purchase, the purchaser acknowledges and accepts that he/she has been adequately informed and is aware of the particular conditions of the experience purchased. Characteristics such as:
Modality of participation, platform of realization
Language in which the experience will be carried out
In the case of the agenda experiences in addition:
The minimum number of attendees for the realization of the experience.
Time and time zone.
In the case of gift experiences in addition:
The maximum number of devices with which it is possible to share the link to participate in the experience.
The date, time, and time zone will be agreed with the purchaser once the purchase has been made.
The language will be chosen by the purchaser among those available for the specific purchased experience.
By making the payment, the purchaser fully and unconditionally acknowledges and accepts the particular conditions applicable to each Experience purchased.
f. Buyer's Cancellation Policy
Yolovivo, S.L. wants to ensure that the purchaser has all possible guarantees to enjoy the Experiences offered.
For this reason, when advance purchases are made to participate in any Experience, the purchaser may cancel participation in it up to 48 hours before the scheduled start time of the event, free of charge.
In addition, Yolovivo, S.L. undertakes to issue a voucher ticket for the value paid as the amount paid so that you can redeem and enjoy subsequent Experiences.
To make the cancellation and request the voucher ticket, the purchaser must notify Yolovivo, S.L., at least 48 hours in advance, by email to email@example.com , indicating:
your identification data (name, surname and email)
details of the experience booked (name of the experience, date and time).
This cancellation policy does not apply to purchases of ticket(s) to participate in Agenda Experiences that have a scheduled start time within 48 hours of purchase.
g. Provision of the contracted service
For the purposes of this contract, it is considered that Yolovivo, S.L. has fulfilled its obligation to provide the contracted service:
By providing the purchaser, prior to the established start time, with all the access data to connect to the digital platform, and provided that the Experience takes place on the scheduled date and time.
If the purchaser purchases a ticket to participate in an Experience that is about to begin or has already begun, the service will be understood to have been provided by Yolovivo, S.L. on providing the access data to connect prior to the scheduled end time.
h. Connection to the event
To enjoy the purchased Experience, the beneficiary must access through the link provided by Yolovivo, S.L.
In the case of the agenda experiences only one (1) device can be connected at a time through this link.
In the case of gift experiences the purchaser can share the link in a maximum of 5 devices that can connect simultaneously to enjoy the experience.
Yolovivo, S.L. reserves the right to exclude/expel the beneficiary of a ticket from the virtual room where the Experience is transmitted if it detects that he/she has improperly shared his/her access link.
It is the responsibility of the person benefiting from the ticket to enjoy any Experience to log in at the established date and time. In the case of gift experiences, it is also the responsibility of the beneficiary that the invited participants receive the link for the connection and connect at the indicated time.
Likewise, it is the responsibility of the beneficiary of the ticket to have a suitable internet connection and access to the digital platform that Yolovivo, S.L. has established to transmit the contracted experience.
Yolovivo, S.L. will not be responsible for technical failures of connection or access to the platform that only affect the connection of the beneficiary of the ticket.
i. Unforeseen events in the implementation of the Experience
All the experiences sold by Yolovivo, S.L. through the Website are designed so that no circumstance or force majeure affects the enjoyment of the same.
However, Yolovivo reserves the right to cancel the scheduled event if they occur:
- Technical difficulties
- Adverse weather conditions
- Insufficient capacity
- Force majeure
- Delays of more than 10 minutes after the estimated start time of the Experience
When any of these circumstances prevent the scheduled event from taking place, Yolovivo, S.L. undertakes to reimburse any amount that may have been paid as a fee.
In these cases, the purchaser may also choose to exchange the amount paid for a voucher for the purchase of another experience carried out by the seller.
j. Withdrawal and refunds
Right of withdrawal: In accordance with current legislation on consumers and users and entertainment and recreational activities, we inform you that once the purchase has been made on the seller's website and you have received the booking confirmation email containing the details of access to the event, the purchaser may not exercise the right of withdrawal.
Right of return
In the event of cancellation of the scheduled event, the purchaser is entitled to receive a refund of the amount paid for the fee.
The refund or the issue of a voucher will be made as soon as possible and in any case within 14 days from the date on which we notify you of the cancellation of the event.
The refund will be made by the same means of payment that the purchaser used to pay for the purchase.
In any case, Yolovivo, S.L. will be subject to the legislation in force at the time of purchase.
k. Exemption from liability
Unless otherwise stipulated by law, Yolovivo, S.L. limits its liability in the following cases:
Yolovivo, S.L. applies all measures concerning a proper connection and correct display of the Experience on the digital platform used, however, is not responsible for technical failures that are attributable to external providers.
Technical failures that due to fortuitous or other causes, prevent the normal operation of the service through the Internet. Lack of availability of the digital platform used for maintenance or other reasons, which prevents access to it at the time of the event.
Yolovivo, S.L. puts all the means at its disposal in order to carry out the purchase process, sending the access data to enjoy the Experience / digital delivery of the ticket(s), however, it is exempt from liability for causes that are not attributable to it, fortuitous events or force majeure.
Yolovivo, S.L. will not be held responsible for computer attacks suffered during the transmission of the event that are caused by third parties and that prevent the correct viewing of the event.
In general, Yolovivo, S.L. shall not be liable for any failure or delay in the fulfilment of any of the obligations assumed, when this is due to events beyond our reasonable control, i.e. due to force majeure, and this may include, but is not limited to.
Strikes, lock-outs or other industrial action.
Civil commotion, riot, invasion, terrorist threat or attack, war (declared or undeclared) or threat or preparation for war.
Fire, explosion, storm, flood, flood, earthquake, subsidence, epidemic or any other natural disaster.
Impossibility of the use of trains, ships, aircraft, motor transport or other means of transport, public or private.
Impossibility of using public or private telecommunications systems.
Acts, decrees, legislation, regulations or restrictions of any government or public authority.
In this way, the obligations will be suspended during the period in which the cause of force majeure continues, and Yolovivo, S.L. will have an extension in the term to fulfil them for a period of time equal to the duration of the cause of force majeure.
Yolovivo, S.L. will use all reasonable means to find a solution that allows us to fulfil our obligations despite the force majeure cause.
l. Communications and notifications by electronic means
By using this Web Site, the buyer accepts that most of the communications with Yolovivo, S.L. will be electronic, by means of e-mail or instant messaging.
For contractual purposes, the buyer consents to use this electronic means of communication and acknowledges that all contracts, notifications, information and other communications that Yolovivo, S.L. sends electronically comply with the legal requirements of being in writing. This condition will not affect the rights recognised by law to the User.
The buyer may send notifications and/or communicate with Yolovivo, S.L. through the contact details provided in these Conditions and, where appropriate, through the contact spaces on the Website.
Likewise, unless otherwise stipulated, Yolovivo, S.L. may contact and/or notify the User by e-mail or at the postal address provided.
No waiver by Yolovivo, S.L. of a specific legal right or action or the lack of requirement by Yolovivo, S.L. of strict compliance by the purchaser of any of its obligations shall constitute a waiver of other rights or actions derived from a contract or from the Conditions, nor shall it exonerate the User from compliance with its obligations.
No waiver by Yolovivo, S.L. of any of the present Conditions or of the rights or actions derived from a contract will have any effect, unless it is expressly established that it is a waiver and it is formalised and communicated to the User in writing.
n. Nullity and ineffectiveness of clauses
If any clause included in these Conditions is declared totally or partially null and void or ineffective, such nullity or ineffectiveness shall only affect that provision, and these General Conditions shall remain in force in all other respects, such provision being deemed not to be included.
o. Data protection
The information or data of a personal nature that the buyer provides to Yolovivo, S.L. in the course of a transaction on the Web Site, will be treated in accordance with the provisions of the data protection policies of this Web Site. By accessing, browsing and/or using the Website, the buyer consents to the processing of such information and data and declares that all the information or data provided is true.
p. Complaints and Claims
The purchaser may send any complaints, claims or any other comments he/she may wish to make to our contact email address via the contact details provided at the beginning of these Terms and Conditions (General information).
Likewise, if a dispute arises from the conclusion of this purchase contract between Yolovivo, S.L. and The Purchaser, The Purchaser as a consumer may request an out-of-court settlement of disputes, in accordance with EU Regulation No. 524/2013 of the European Parliament and of the Council of 21 May 2013 on the settlement of consumer disputes online. Yolovivo, S.L. reserves the right to refuse to accept the complaint submitted through the platform.
q. Applicable Law and Jurisdiction
Access to, browsing and/or use of this Website and contracts for the purchase of products through the same shall be governed by Spanish law.
Any controversy, problem or disagreement that arises or is related to the access, navigation and/or use of the Website, or to the interpretation and execution of these Conditions, or to the sales contracts between Yolovivo, S.L. and the buyer, will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals.
